Right of Withdrawal
Pursuant to the provisions of the Consumer Code, the Client has the right to withdraw from the purchase contract for any reason whatsoever, without the need to provide explanations and without any penalty, within 14 (fourteen) days from the Client’s physical receipt of the purchased Products. For this purpose, the date of delivery indicated on the appropriate documentation of the courier in charge of the shipment shall be deemed authentic. In order to exercise this right, the Client, within the period previously indicated, must send Henge an explicit written communication using: (i) the withdrawal procedure that may be present on the Site; or (ii) by downloading and completing the Withdrawal Form available on the Site. The Withdrawal Form must be sent to the following e-mail address atelier@henge07.com within the aforementioned term of 14 (fourteen) days Once the aforementioned communication of withdrawal has been received, the Client is obliged to return the Products to Henge without undue delay, and in any case within 14 (fourteen) days from the date of communication of the exercise of the right of withdrawal. This term will be considered respected if the Client returns the Products for which he has exercised the right of withdrawal before the expiry of the period of 14 (fourteen) days from the date of sending the communication of exercising the right of withdrawal. Via Fossa n° 1 31051 - Follina (TV) Italy The Products purchased must be returned intact and unused, complete with label and with all accessories and any spare parts, in the original packaging, complete in all its parts (including packaging and any documentation, etc.). Should the Client exercise the right of withdrawal in a manner that does not comply with the terms and conditions set forth in this article, he/she shall not be entitled to a refund. The Client shall not incur any costs or penalties as a consequence of exercising the right of withdrawal, except for the cost of returning the Products, which shall be borne by the Client The Client shall be liable for any decrease in the value of the Products resulting from the handling of the Products other than what is necessary to establish the nature, characteristics and functioning of the goods. Having received a notice of withdrawal in accordance with the other conditions indicated in this article, Henge will carry out the reimbursement of the sums paid for the purchase, including delivery costs (with the exception of the additional costs deriving from the possible choice of a type of delivery other than the least expensive type of standard delivery offered on the Site at the time the Order is sent), using the same means of payment used by the Client for the purchase of the Product, unless a different and express modality is agreed between the Client and Henge. The Client has the right to receive the reimbursement within 14 (fourteen) days from the receipt by Henge of the communication of exercise of the withdrawal by the Client. In any case, Henge, in accordance with art. 56 of the Consumer Code, reserves the right to withhold the refund until it has received the returned Products, or until the Client has demonstrated that he has returned the said Products, whichever situation occurs first. If there is no correspondence between the addressee of the Products indicated in the Order Form and the person who made the payment of the sums due for their purchase, the reimbursement of such sums, in the event of the exercise of the right of withdrawal, will be made by Henge to the person who made the payment. The consumer’s right of withdrawal is however subject to the exceptions set out in art. 59 of the Consumer Code.
Warranty and Complaints
All Products sold by Henge are covered by a 24 (twenty-four) month warranty for conformity defects from the moment of their delivery to the Client. To make use of the warranty service, the Client must retain the receipt (or the delivery note) that he will receive in electronic PDF format or by link. In order to enforce the legal guarantee referred to in this article, the Client shall: (i) follow the procedure that may be present on the Site; or (ii) download from the Site and complete the Return Form and send it to Henge by e-mail to the following address atelier@henge07.com. Henge does not guarantee quality requirements, description, type, quantity functionality, compatibility, suitability for use, supply with accessories, instructions, updates not specifically indicated in these General Conditions and/or in the Order and/or on the Site and/or in written documentation relating to the Products. In the event of a lack of conformity of the Products, the Client shall have the right, free of charge, to have the conformity of the Products remedied by repair or replacement within a reasonable period of time from the date Henge was informed by the Client of the lack of conformity. Such remedy may be requested by the Client, unless this is impossible or would impose disproportionate costs on Henge, taking into account all the circumstances of the case, including: (i) the value that the said Products would have if there were no conformity defect; (ii) the extent of the conformity defect; (iii) the possibility of pursuing the alternative remedy without significant inconvenience to the Client. For the purpose of repair and/or replacement of the Product, the Client must communicate to Henge: (i) the batch number to which the Product belongs; (ii) the photographs depicting the Product, it being understood that Henge reserves the right to request further information from the Client for the purpose of exercising the right to repair and/or replacement. In the event that, for whatever reason, Henge is unable to return to its Client a Product under warranty (restored or replaced), Henge may proceed at its own discretion to refund the amount paid, taking into account the use of the good, or to replace it with a Product of equal or superior characteristics. The Client is entitled to a proportional reduction in price or to termination of the sales contract in the event that: (i) Henge has failed to repair or replace or has refused to make the Products compliant; (ii) a conformity defect manifests itself, despite Henge’s attempt to restore the conformity of the Product; (iii) the lack of conformity is so serious as to justify immediate reduction of the price or termination of the Contract of sale; or (iv) Henge has declared, or it is clear from the circumstances that, it will not restore the conformity of the Product within a reasonable period or without considerable inconvenience to the Client. In cases where the Client is given the right to terminate the Contract, the Client must express his decision by specific communication to that effect to be sent to Henge by e-mail to the following address [•]. In case of termination of the Contract, the Product must be returned by the Client in its original packaging, complete in all its parts (including packaging and eventual documentation and accessory equipment); in order to limit damages to the original packaging, we recommend to put it in a second box; in all cases the affixing of labels or adhesive tapes directly on the original packaging of the Product must be avoided. Henge will reimburse the Client for the price paid for the Product following receipt of the same or, in the case of a price reduction, following receipt of proof provided by the Client that he has returned the Product. The shipping costs for the purposes of exercising the rights provided for in this article are the responsibility of Henge, which may decide, at its own discretion, the carrier to be used and the manner of shipping. The Client is obliged to respect the shipping conditions indicated by Henge.
